Human Rights Implications of the Marriage (Same Sex Couples) Bill

On this page we have published legal advice given to the Catholic Bishops' Conference of England and Wales by Christopher McCrudden, Blackstone Chambers, Temple, London EC4 on 15 April 2013. 

The specific human rights concerns identified fall, broadly, into four categories:

  • Religious freedom not to solemnize same-sex marriages
  • Religious freedom in education
  • Registrars and conscientious objection
  • Freedom of expression of those who oppose same sex marriage

"My advice is that in the four respects identified in paragraph 6 above, the state will not meet its positive obligation to secure religious pluralism in the public sphere due to the way in which the Bill is drafted, thus raising important human rights concerns which should be brought to Parliament’s attention."
